释义	人死债消是没有法律依据的，在我国，人死了债务还是需要偿还的。如果有遗产留下，遗产应当优先用于清偿税务以及债务，如果清偿后仍有剩余，可以由继承人继承。如果债务人死亡后、遗留的遗产不足以清偿全部债务的，则不足部分，继承人不再继续清偿。当然，继承人自愿继续进行清偿的也是可以的。《民法典》第一千一百六十一条继承人以所得遗产实际价值为限清偿被继承人依法应当缴纳的税款和债务。超过遗产实际价值部分，继承人自愿偿还的不在此限。继承人放弃继承的，对被继承人依法应当缴纳的税款和债务可以不负清偿责任。
