流产假是国家法定假么
释义
属于国家 法定节假日 。 根据《 女职工 劳动保护特别规定》规定，女职工生育享受98天 产假 ，其中产前可以休假15天；难产的，应增加产假15天；生育多胞胎的，每多生育1个婴儿，可增加产假15天。虽然《女职工劳动保护特别规定》未明确规定是否包含国家法定节假日，但按立法原意，产假是按自然日计算的，包括了期间的法定休息日和法定节假日。
法律依据：
《女职工劳动保护规定》第八条规定，女职工怀孕流产的，其所在单位应当根据医务部门的证明，给予一定时间的产假。
