释义	法律分析：监察机关在调查贪污贿赂、失职渎职等职务犯罪案件过程中，被调查人逃匿或者死亡，有必要继续调查的，经省级以上监察机关批准，应当继续调查并作出结论。被调查人逃匿，在通缉一年后不能到案，或者死亡的，由监察机关提请人民检察院依照法定程序，向人民法院提出没收违法所得的申请。法律依据：《中华人民共和国监察法》第四十六条监察机关经调查，对违法取得的财物，依法予以没收、追缴或者责令退赔；对涉嫌犯罪取得的财物，应当随案移送人民检察院。
