释义	押金是担保物权的一种，是质押担保的一种特殊形式，即为了担保债务的履行，债务人或者第三人将一定数额的金钱或者等价物移交债权人占有，在债务人不履行合同的债务的时候，债权人可从押金中优先受偿。押金是民间交易过程中习惯上采用的方式，我国法律既未明确承认也不禁止押金这种担保方式。保证金，是指合同当事人一方或双方为保证合同的履行，而留存于对方或提存于第三方的款项。
