法律分析：和不满十四周岁的幼女发生性关系，不论她是否自愿，都以强奸论处。但是，和超过十四周岁的少女的性行为，只要双方自愿，就不是违法行为，只是道德失控的问题。
法律依据：《中华人民共和国刑法》 第二百三十六条 对已满十四周岁不满十六周岁的未成年女性负有监护、收养、看护、教育、医疗等特殊职责的人员，与该未成年女性发生性关系的，处三年以下有期徒刑；情节恶劣的，处三年以上十年以下有期徒刑。 有前款行为，同时又构成本法第二百三十六条规定之罪的，依照处罚较重的规定定罪处罚。
