释义	法律分析：主观故意是行为人实施犯罪行行为时的一种主观心理状态，它包括认识因素和意志因素两个层面。要准确认定行为人的主观故意，首先必须查行为人的认识状态，即行为人是否对相应犯构成要件中的客观方面也就是事实有着明确的认识，以此为基础，再考察行为人是否存在犯罪故意以及直接故意还是间接故意。法律依据：《中华人民共和国刑法》第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
