释义	怎么区分股权与股份股权即股票持有者所具有的与其拥有的股票比例相应的权益及承担一定责任的权利。基于股东地位可对公司主张的权利，是股权。股份有限公司的股权为股票表彰的权利。股权的主体是股东。一般而言，公司是资合而成的经济组织，其股东的个性无关紧要，因而不论自然人还是法人都可以成为股东。股份是股份公司均分其资本的基本计量单位，对股东而言，则表示其在公司资本中所占的投资份额。股份是构成公司资本的最小的均等的计量单位。把公司资本分给为股份，所发行的股份就是资本总额。
