什么样的担保无效
释义
有下列情形之一的，对外担保合同无效：1、未经国家主管部门批准或者登记对外担保的;2、未经国家有关主管部门批准或者登记，为境外机构向境内债权人提供担保的;3、为外商投资企业注册资本、外商投资企业中的外文投资部分的对外债务提供担保的;4、主合同变更或者债权人将对外担保项下的权利转让，未经担保人同意和国家有关主管部门批准的，担保人不再承担担保责任，但法律法规另有规定的除外。
