释义	法律分析：派出所没有行政拘留的决定权。需要对违法人进行行政拘留处罚的，应当报请县级以上公安机关负责人批准。在紧急情况下，派出所可以先采取强制后再报请批准。如果要实施行政拘留，必须由县级公安机关决定，公安机关执行拘留必须出示县级以上公安机关负责人签发的拘留证。对被决定给予行政拘留处罚的人，由作出决定的公安机关送达拘留所执行。法律依据：《中华人民共和国治安管理处罚法》第九十一条治安管理处罚由县级以上人民政府公安机关决定；其中警告、五百元以下的罚款可以由公安派出所决定。
