释义	听证是指行政机关在作出行政处罚决定之前听取当事人的陈述和申辩、由听证程序参加人相互进行质问辩论和反驳，从而进一步查明事实的活动。提出听证申请的方式可以是口头方式，也可以是书面方式。当事人口头提出书面申请的，受理机关应当记录在案。当事人应当在告知后的3日内提出听证申请。法律依据《行政处罚法》第四十二条
