释义	债务人死亡的，如果没有遗产，但是债务有保证人的，应当由保证人承担保证责任；如果该债务属于夫妻共同债务的，债务人死亡后应当由其配偶承担债务。如果既没有保证人又不属于共同债务的，债权债务消灭，不需要再还。法律依据《民法典》第一千一百五十九条，分割遗产，应当清偿被继承人依法应当缴纳的税款和债务；但是，应当为缺乏劳动能力又没有生活来源的继承人保留必要的遗产。
