释义	法律分析：聚众扰乱社会秩序罪的犯罪主体只能是扰乱社会秩序的首要分子和其他积极参加者。所谓首要分子，即在扰乱社会秩序犯罪中起组织、策划、指挥作用的犯罪分子。所谓其他积极参加者，是指除首要分子以外的在犯罪活动中起主要作用的犯罪分子。法律依据：《中华人民共和国刑法》第二百九十条聚众扰乱社会秩序，情节严重，致使工作、生产、营业和教学、科研、医疗无法进行，造成严重损失的，对首要分子，处三年以上七年以下有期徒刑；对其他积极参加的，处三年以下有期徒刑、拘役、管制或者剥夺政治权利。
