释义	同时履行抗辩权：指双务合同的当事人一方在对方未为对待给付以前，可拒绝履行自己的债务之权。构成要件：一、须有同一双务合同互负债务；二、须双方互负的债务均已届清偿期；三、须对方未履行债务或未提出履行债务；四、须对方的对待给付是可能履行的。法律依据：《民法典》第七百八十八条：建设工程合同是承包人进行工程建设，发包人支付工程价款的合同。在建设工程合同中，发包人的主要义务是支付工程价款，在实践中，合同往往约定发包人承担原材料、资金、设备、场地等义务。
