释义	目前我国的法律仅规定二审判决是生效判决，并没有明确具体的生效时间，那么在司法实践中，主要有三种不同的观点：二审判决作出之日生效;二审判决宣判之日生效;二审判决送达之日生效。《中华人民共和国刑事诉讼法》第二百零二条宣告判决，一律公开进行。当庭宣告判决的，应当在五日以内将判决书送达当事人和提起公诉的人民检察院;定期宣告判决的，应当在宣告后立即将判决书送达当事人和提起公诉的人民检察院。判决书应当同时送达辩护人、诉讼代理人。
