释义	法律分析：劳动者实现劳动权的无保障;不能有效约束用人单位合理使用劳动力、巩固劳动纪律、提高劳动生产率;并不能有效减少和防止发生劳动争议。也就是说如果一旦劳动者的合法权益受到侵害，由于不存在劳动关系很可能是无法得到保障，单位也会因此逃避了应负的责任。法律依据：《中华人民共和国劳动合同法》第八十七条用人单位违反本法规定解除或者终止劳动合同的，应当依照本法第四十七条规定的经济补偿标准的二倍向劳动者支付赔偿金。
