释义	劳动关系，从法律意义上讲，是指用人单位招用劳动者为其成员，劳动者在用人单位的管理下提供有报酬的劳动而产生的权利义务关系。四种情形不算劳动关系： 1.用工事实存在，且双方的权利和义务已实际履行，但用人单位不具备用工主体资格的; 2.在承揽合同关系中，承揽人按照定作人的要求完成工作并交付工作成果，由定作人支付劳动报酬的; 3.受雇人为雇佣人提供劳务，雇佣人支付劳动报酬的; 4.其他不应认定存在劳动关系或事实劳动关系的情形。
