释义	法律分析：如果这个土地本来就是归集体所有的，那么老人去世之后土地肯定是要归还集体的。但是如果是承包给个人的话，那么老人就是这个土地的承包责任人，其亲属是联合承包人，当老人不在了，就理所应当地转交由联合承包人所有。法律依据：《农村土地承包法》第三十一条承包人可以取得的合同收入，按照继承法的规定继承。与森林签订合同的承包商死亡，继承人可以在合同期间继续合同。第五十条通过招标，拍卖，协商等方式取得合同登陆权的，承包人死亡，合同收入按照继承合同的规定继承，继承人可以在合同期内继续承包。
