释义	构成抢劫罪和敲诈勒索罪，应该数罪并罚。抢劫罪与敲诈勒索罪尽管有一定的相似性，即都有威胁的手段，但二者有严格的区别，它们在“胁迫”的内容与形式上不同：（一）威胁的内容是否仅限于暴力性的人身侵害；（二）人身暴力性侵害极非法取得财物的时间是否只能在当场、当时取得，即如果同时具备暴力性（针对胁迫的内容而言）和当场性（针对胁迫内容及取得财物的实现而言）两个特征，就属于抢劫罪中的“胁迫”，否则就是敲诈勒索罪中的“胁迫”。
