释义	法律分析：一般来说年满18周岁才是完全民事行为能力人，但是我国法律还规定，年满16周岁以自己的劳动作为主要生活来源的，视为完全民事行为能力人。因此，用人单位在与劳动者签订劳动合同时，应查验劳动者是否年满16周岁，否则可能会因使用童工而被罚。禁止使用童工是国际社会的普遍做法，我国也明确禁止使用童工。法律依据：《中华人民共和国劳动法》第九十四条用人单位非法招用未满十六周岁的未成年人的，由劳动行政部门责令改正，处以罚款；情节严重的，由工商行政管理部门吊销营业执照。
