释义	法律分析：从大的概念上讲法定代表人也是劳动者。如果分类讲法定代表人是资方代表，劳动者即提供劳动付出的员工。在劳资关系中，前者是“资”的代表人，后果是“劳”的实际人。劳资纠纷中法定代表人就不是劳动者了而是“资方”的代表人。法律依据：《中华人民共和国劳动法》第二条在中华人民共和国境内的企业、个体经济组织（以下统称用人单位）和与之形成劳动关系的劳动者，适用本法。国家机关、事业组织、社会团体和与之建立劳动合同关系的劳动者，依照本法执行。
