释义	法律分析：在同等条件下原承租人享有优先承租权，即使房租租赁合同中没有约定优先承租权，如果出租人未征求原承租人的意见就将租赁房屋出租与第三人，原承租人可以向出租人要求同等条件下的优先承租权。法律依据：《中华人民共和国民法典》第七百三十四条租赁期限届满，承租人继续使用租赁物，出租人没有提出异议的，原租赁合同继续有效，但是租赁期限为不定期。租赁期限届满，房屋承租人享有以同等条件优先承租的权利。
