释义	法律分析：雇佣合同中雇员与雇主具有一定的人身依附性，即雇员在一定程度上要服从雇主的监管和安排，具有隶属性。而承揽合同中承揽人在完成工作中具有独立性，如何完成工作，由承揽人自己决定，不受定作人的监控，承揽人主要是依靠自己的技术力量和能力来完成工作，双方之间不存在支配与服从关系。法律依据：《中华人民共和国民法典》第一千一百九十三条承揽人在完成工作过程中造成第三人损害或者自己损害的，定作人不承担侵权责任。但是，定作人对定作、指示或者选任有过错的，应当承担相应的责任。
