释义	法律分析：提交主体不同：投标保证金由所有投标人提交，保证金仅由中标人提交。投标保函是由投标人申请银行开立的保证函，保证投标人在中标人确定之前不得撤销投标，在中标后应当按照招标文件和投标文件与招标人签订合同。如果投标人违反规定，开立保证函的银行将根据招标人的通知，支付银行保函中规定数额的资金给招标人。投标保函是投标保证金的一种形式。法律依据：《中华人民共和国招标投标法实施条例》第26条第2款依法必须进行招标的项目的境内投标单位，以现金或者支票形式提交的投标保证金应从其基本账户转出。
