强令违章冒险作业罪构成?
释义
客体要件。侵犯的客体：是公共安全。客观要件。客观方面：表现为强令违章冒险作业，因而发生重大伤亡事故或者造成其他严重后果的行为，这里所说的强令是指明知违章并存在着很大的危险而仍然强迫下属进行作业。主体要件。犯罪主体：是一般主体，包括具有强令资格的人，通常情况下是作业的领导者、指挥者、调度者。主观要件。主观方面：是过失。所谓过失是指行为人对所发生的后果而言，而对于既违章又冒险则是明知的。
