释义	抵押人可以出租抵押房屋，抵押权与出租权是房屋所有权人的权利，将已抵押房屋出租的，租赁合同有效，但租赁权不能对抗抵押权。将已抵押的房屋出租时，如果抵押权人未书面告知承租人该房屋已抵押，抵押权人对出租房屋造成承租人的损失承担赔偿责任；如果抵押权人已书面告知承租人对该房屋已抵押的，抵押权实现造成承租人的损失，由承租人自己承担。【本文关联的相关法律依据】《中华人民共和国民法典》第四百零五条抵押权设立前，抵押财产已经出租并转移占有的，原租赁关系不受该抵押权的影响。
