没有合同不能出担保函。担保合同是主合同的从合同，主合同无效，担保合同无效，所以没有合同自然不能出担保函。所谓担保函是指银行、保险公司、担保公司或个人应申请人的请求，向第三方开立的一种书面信用担保凭证。
【法律依据】：
《中华人民共和国民法典》 第六百八十六条 当事人在保证合同中对保证方式没有约定或者约定不明确的，按照一般保证承担保证责任。这与现行《担保法》第十九条的规定正好相反，该条规定，对保证方式没有约定或者约定不明的，按连带责任保证承担保证责任。
