释义	法律分析：当事人可以在工程合同中约定质保金的退还期限，可以约定达到期限后一次性返还，也可以约定到一定期为时段，分期返还。缺陷责任期内，承包人履行义务，到期后，承包人可以向发包人申请返还保证金。发包人接到申请核实后14日内将保证金返还给承包人，逾期支付的，计付利息，并承担违约责任。法律依据：《建设工程质量保证金管理暂行办法》第十条缺陷责任期内，承包人认真履行合同约定的责任，到期后，承包人向发包人申请返还保证金。
