法律分析：看情况。法律并没有对绩效工资做强制性规定，但可以看一下当时签订的劳动合同，如果合同有规定，但公司没有发放则是违约，可以要求公司发放绩效工资。绩效工资主要是根据员工的第三种劳动即凝固劳动来支付工资，是以实际的、最终的劳动成果确定员工薪酬的工资制度。
法律依据：《中华人民共和国劳动法》第四十六条 工资分配应当遵循按劳分配原则，实行同工同酬。工资水平在经济发展的基础上逐步提高。国家对工资总量实行宏观调控。
