开车门被后车撞车门责任 |
| 释义 |
1、如果后车所行驶的车道正常（机动车在机动车道行驶、非机动车在非机动车道行驶），由于是前车突然开车门。而后车撞上前车的车门的，则应由前车负事故全部责任，后车没有责任。2、如果后车所行驶的车道不正常（如机动车在非机动车道行驶），或前车虽然开车门，而后车是因操作不当而撞上前车的，则应根据现场的实际情况，由交警来认定具体的责任。3、如果前车开门与事故无关，是由于后车没注意而撞上的，且前车属于违停的，则原则上应由后车负事故的隐患主要责任，前车负次要责任。4、如果前车是在停车位正常停车的，则应由后车负全责 。法律依据：《中华人民共和国道路交通安全法实施条例》 第七十七条 乘坐机动车应当遵守下列规定：(一)不得在机动车道上拦乘机动车;(二)在机动车道上不得从机动车左侧上下车;(三)开关车门不得妨碍其他车辆和行人通行;(四)机动车行驶中，不得干扰驾驶，不得将身体任何部分伸出车外，不得跳车;(五)乘坐两轮摩托车应当正向骑坐。
