释义	公务员不得“从事或者参与营利性活动，在企业或者其他营利性组织中兼任职务”。不少人据此就认定，公职人员是不可以开网约车的，因为违反法律规定。但是，我们应该明确，法律法规之所以这样规定，是为了防止公务员利用手中的权力搞权力寻租。也就是说，法律法规是针对公务员权力约束而制定的。如果按照这样的法理逻辑，公务员开网约车根本就不存在权力寻租等违规行为，因此公务员在非工作时间开网约车应该不在禁止的范围之内。
