重婚罪属于什么案件

法律分析：重婚罪既可以是自诉案件也可以是公诉案件。重婚罪是指有配偶又与他人结婚或者明知他人有配偶而与之结婚的行为。重婚罪既是自诉案件，也可以转化为公诉案件(只有在被害人不告诉情况下其他公民向检察机关控告才转为公诉案件)。我国采公诉兼自诉制。由于在公诉兼自诉的模式下，公诉与自诉的关系实际上表现为一种普遍与特殊的关系，因而两者关系的内容主要取决于自诉制度的具体设计。
法律依据：《中华人民共和国刑法》 第二百五十八条 有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
