释义	法律分析：从现行我国相关法律来说，法官的释明权可以在对上述所有方面都进行释明。当当事人主张的法律关系或者民事行为的效力与人民法院根据案件事实作出的认定不一致时，法官给予当事人一定程度的司法救济，原本并不违反法律规定，规定法院应当告知当事人变更诉讼请求，即法官鼓励当事人变更诉讼请求。法律依据：《中华人民共和国民事诉讼法》第八条民事诉讼当事人有平等的诉讼权利。人民法院审理民事案件，应当保障和便利当事人行使诉讼权利，对当事人在适用法律上一律平等。
