释义	法律分析：撤诉相当于没有提起诉讼，可以再次提起，但是基于调解结案的诉讼不得再次起诉。只要在诉讼时效范围内，仍可以起诉。法律依据：《中华人民共和国民事诉讼法》第一百四十五条宣判前，原告申请撤诉的，是否准许，由人民法院裁定。人民法院裁定不准许撤诉的，原告经传票传唤，无正当理由拒不到庭的，可以缺席判决。第四百一十条一审原告在再审审理程序中申请撤回起诉，经其他当事人同意，且不损害国家利益、社会公共利益、他人合法权益的，人民法院可以准许。裁定准许撤诉的，应当一并撤销原判决。
