2、依据《劳动合同法》37条，你提前30天提出的书面离职，不需要用人单位批准就可以离职。其中，试用期提前3天书面提出;
3、没有提前30天提出离职，用人单位也没有违法情况存在，直接提交辞职信就走人，这个时候就是你违法了，给用人单位造成的直接经济损失、招 聘你产生的费用，你要承担。支付相应用人单位损失后，可以要求用人单位为你办理离职手续;
