涉外民事诉讼指的是什么

涉外民事诉讼,是指具有涉外因素的民事诉讼。涉外因素是指具有以下三种情况之一：
第一，诉讼主体涉外，即诉讼一方或者双方当事人是外国人、无国籍人或者外国企业和组织；人民法院在审理国内民商事案件过程中，因追加当事人或者第三人而使得案件具有涉外因素的，属于涉外民商事案件。
第二，作为诉讼标的的法律事实涉外。
第三，诉讼标的物涉外。
