释义	法律分析：如果允许当事人在合同中订立免除故意或重大过失责任的条款，则无异于鼓励当事人不履行合同或不负责任地履行合同，这就与民法通则规定的诚实信用的原则相违背，且不符合合同订立的目的。法律依据：《希腊民法典》第三百三十二条旨在预先免除或限制对故意或重大过失所负责任的协议无效。我国合同法亦规定因故意或重大过失造成对方财产损失的免责条款无效。目前有些商品房预售合同约定：因售房方的过失行为导致的损害，购房方不得要求赔偿，这一免责条款中的过失行为应视为不包括重大过失行为在内。
