《中华人民共和国刑法》 第二百三十四条 故意伤害他人身体的，处三年以下有期徒刑、拘役或者管制。
犯前款罪，致人重伤的，处三年以上十年以下有期徒刑人死亡或者以特别残忍手段致人重伤造成严重残疾的，处十年以上有期徒刑、无期徒刑或者死刑。本法另有规定的，依照规定。
《公安机关办理刑事案件程序规定》
第一百七十一条 对接受的案件，或者发现的犯罪线索，公安机关应当迅速进行审查。对于在审查中发现案件事实或者线索不明的，必要时，经办案部门负责人批准，可以进行初查。初查过程中，公安机关可以依照有关法律和规定采取询问、查询、勘验、鉴定和调取证据材料等不限制被调查对象人身、财产权利的措施。
第一百七十五条 公安机关接受案件后，经审查，认为有犯罪事实需要追究刑事责任，且属于自己管辖的，经县级以上公安机关负责人批准，予以立案；认为没有犯罪事实，或者犯罪事实显著轻微不需要追究刑事责任，或者具有其他依法不追究刑事责任情形的，经县级以上公安机关负责人批准，不予立案。
