释义	空调病是否属于工伤根据我国《职业病防治法》，高温列为法定职业病危害因素，并将职业性中暑列为法定职业病，而“空调病”尚不属于工伤范畴。劳动部门表示，中暑职工是企事业单位或个体经济组织的劳动者，中暑发生在生产过程中，工作环境符合高温条件，并被职业病鉴定机构认定为职业性中暑。而因办公环境空调温度过低而引起职工身体不适，只能由用人单位与办公用地产权单位协商，通过调整室温来解决。目前，尚没有职业性“空调病”的鉴定，同时也没有将此列为职业病的计划。
