判刑后生病怎么处理 |

法律分析：看守所和监狱内配备有必要的医疗器械和常用药品，监狱的医疗设施和机构更为完善。在此期间如果罪犯生病的，应当给予及时治疗;需要到地方医院治疗的，当地医院应当负责治疗;对罪犯确有严重疾病，必须保外就医的，由省级人民政府指定的医院诊断并开具证明文件，可以暂予监外执行。在交付执行前，暂予监外执行由交付执行的人民法院决定;在交付执行后，暂予监外执行由监狱或者看守所提出书面意见，报省级以上监狱管理机关或者设区的市一级以上公安机关批准。
法律依据：《中华人民共和国刑事诉讼法》 第二百六十五条 对被判处有期徒刑或者拘役的罪犯，有下列情形之一的，可以暂予监外执行：
(一)有严重疾病需要保外就医的;
(二)怀孕或者正在哺乳自己婴儿的妇女;
(三)生活不能自理，适用暂予监外执行不致危害社会的。
对被判处无期徒刑的罪犯，有前款第二项规定情形的，可以暂予监外执行。
对适用保外就医可能有社会危险性的罪犯，或者自伤自残的罪犯，不得保外就医。
对罪犯确有严重疾病，必须保外就医的，由省级人民政府指定的医院诊断并开具证明文件。
在交付执行前，暂予监外执行由交付执行的人民法院决定;在交付执行后，暂予监外执行由监狱或者看守所提出书面意见，报省级以上监狱管理机关或者设区的市一级以上公安机关批准。
