释义	法律分析：黑白合同，是指在建设工程招投标中，合同当事人出于某种利益考量，就同一合同标的物签订的、价款存在差异或履行方式存在差异的两份合同，其中一份作了登记、备案等公示，而另一份则恰恰相反。法律依据：《关于审理建设工程施工合同纠纷案件适用法律问题的解释》第二十一条当事人就同一建设工程另行订立的建设工程施工合同与经过备案的中标合同实质性内容不一致的，应当以备案的中标合同作为结算工程款的依据。
