警察作为证人能不能是办案人 法律问题
释义
法律分析:
不可以。刑事诉讼法规定任何了解案件的人都可以作为证人， 但是刑事诉讼中所有的自然人都只能有一个身份，如果某个警察参与了这个案件的侦查，就不能成为这个案件的证人了。
法律依据:
《中华人民共和国刑事诉讼法》 第二十八条 担任过本案证人的侦查人员应当自行回避，当事人及其法定代理人也有权要求他们回避。
