释义	醉酒后打架量刑不会从轻处罚。《刑法》第18条第4款规定：醉酒的人犯罪，应当负刑事责任。在生理性醉酒的情况下，行为人并没有丧失辨认控制能力，故对其实施的犯罪行为应当承担刑事责任;即使其辨认控制能力有所减弱，但由于醉酒由行为人自己造成，也不得从轻或者减轻处罚。故《刑法》规定，醉酒的人犯罪应当负刑事责任。
