收取餐位费的处罚条例
释义
法律分析：收餐位费是违法的，饭店无权向顾客收取其所谓的餐位费。
法律依据：《中华人民共和国食品安全法》
第四条 食品生产经营者对其生产经营食品的安全负责。食品生产经营者应当依照法律法规和食品安全标准从事生产经营活动保证食品安全诚信自律对社会和公众负责接受社会监督承担社会责任。
第三十三条 餐具饮具和盛放直接入口食品的容器使用前应当洗净消毒炊具用具用后应当洗净保持清洁；饭店作为经营者本就具有向消费者提供安全洁净的餐具是其不可推卸的法定义务和责任因而饭店无权收取一次性餐具的餐具费。
