释义	客体是国家边境的正常管理秩序，犯罪的对象仅限于国家边境的界桩。客观方面表现为破坏国家边境界桩的行为，指捣毁、盗窃、拆除、损坏、掩埋、移动位置，等等。主体是一般主体。可以是中国人，也可以是外国人主观方面表现为故意，即明知是界碑、界桩而故意加以破坏的才构成破坏界桩罪，过失破坏国家边境界桩、界碑的，不能构成本罪。【法律依据】《中华人民共和国刑法》第三百二十三条故意破坏国家边境的界碑、界桩或者永久性测量标志的，处三年以下有期徒刑或者拘役。
