法律分析：死刑适用的限制条件如下：1、在死刑适用条件方面：死刑只适用于罪行极其严重的犯罪分子。2、在死刑适用对象方面：犯罪的时候不满18周岁和审判时怀孕的妇女和年满75周岁的人，不适用死刑。审判时怀孕的妇女包括审判时和羁押时怀孕的妇女，也包括在审判时和羁押时流产的妇女。3、在死刑适用程序方面：死刑除依法由最高人民法院判决的以外，都应当报请最高人民法院核准。4、在死刑执行限制方面：对于应当判处死刑的犯罪分子，如果不是必须立即执行的，可以判处死刑同时宣告缓期两年执行。缓刑期间有犯新罪并且是故意的，由最高人民法院核准才能判处死刑。5、刑法分则的限制：(1)并不是所有的犯罪都规定了死刑(2)在规定死刑的犯罪中，都以情节特别严重，后果特别严重作为死刑的判决的条件。
法律依据：《中华人民共和国刑法》 第四十八条 死刑只适用于罪行极其严重的犯罪分子。对于应当判处死刑的犯罪分子，如果不是必须立即执行的，可以判处死刑同时宣告缓期二年执行。死刑除依法由最高人民法院判决的以外，都应当报请最高人民法院核准。死刑缓期执行的，可以由高级人民法院判决或者核准。
