释义	法律客观：《工程建设项目施工招标投标办法》第三十七条招标人可以在招标文件中要求投标人提交投标保证金。投标保证金除现金外，可以是银行出具的银行保函、保兑支票、银行汇票或现金支票。投标保证金不得超过项目估算价的百分之二，但最高不得超过八十万元人民币。投标保证金有效期应当与投标有效期一致。投标人应当按照招标文件要求的方式和金额，将投标保证金随投标文件提交给招标人或其委托的招标代理机构。依法必须进行施工招标的项目的境内投标单位，以现金或者支票形式提交的投标保证金应当从其基本账户转出。
