释义	法律分析：《劳动部关于实行劳动合同制度若干问题的通知》第十条规定：在固定工制度向劳动合同制度转变过程中，对已经患有精神病但得到控制的职工，用人单位应当安排适当工作，签订劳动合同；对病情严重不能控制的，应当送医院治疗。医疗终结后，按照国家有关规定办理退休或退职手续。第十一条规定：用人单位对新招用的职工，在试用期内发现并经有关机关确认患有精神病的，可以解除劳动合同。以上解除合同的条件有一点需要大家注意的就是，是否有精神病，需有关机关作出确认后才能作为用人单位解除合同的依据。
