释义	法律分析：人身伤害的诉讼时效是一年。即使超过诉讼时效，法院仍应受理，法院受理案件时，不进行实体性审查，只进行程序性审查，也就是说具备起诉条件，当事人就可以起诉，但是超过诉讼时效的丧失了实体性的胜诉权，只要对方当事人提出，法院便可以审查诉讼时效是否届满，如已届满，驳回诉讼请求，注意驳回的是诉讼请求，而不是诉讼。法律依据：《中华人民共和国民事诉讼法》第三条人民法院受理公民之间、法人之间、其他组织之间以及他们相互之间因财产关系和人身关系提起的民事诉讼，适用本法的规定。
