释义	在人民法院庭审中,第三人可以不出庭。有独立请求权的第三人经法院传票传唤,没有正当理由拒不到庭的,或者中途退庭的,按撤诉处理。无独立请求权的第三人经法院传票传唤,没有正当理由拒不到庭,或者没有经法庭许可中途退庭的,不影响案件的审理。法律依据：《中华人民共和国民事诉讼法》第一百零九条人民法院对必须到庭的被告，经两次传票传唤，无正当理由拒不到庭的，可以拘传。第一百四十四条被告经传票传唤，无正当理由拒不到庭的，或者未经法庭许可中途退庭的，可以缺席判决。
