法律依据：《民法典》 第一千二百五十五条 医疗机构及其医务人员应当按照规定填写并妥善保管住院志、医嘱单、检验报告、手术及麻醉记录、病理资料、护理记录、医疗费用等病历资料。患者要求查阅、复制前款规定的病历资料的，医疗机构应当提供。这是关于医疗机构对病历资料的妥善保管和提供查询义务的规定。 《民法典》 第一千二百二十一条 医务人员在诊疗活动中未尽到与当时的医疗水平相应的诊疗义务，造成患者损害的，医疗机构应当承担赔偿责任。这一规定确认，医疗机构及医务人员从事病情检验、诊断、治疗方法的选择，治疗措施的执行，病情发展过程的追踪，以及术后照护等诊疗行为中，存在不符合当时的医疗水平的过失行为，医疗机构应当承担赔偿责任。因此，医疗技术损害责任是医疗机构及医务人员具有医疗技术过失的医疗损害责任类型。
